Ellie Schilling succeeded in proving at the First Circuit Court of Appeal that civil fines issued by the Department of Health and Hospitals to a healthcare facility were unauthorized. The Department of Health and Hospitals claimed to have statutory authority to issue civil fines to an abortion clinic; however, the Department ignored its own regulatory framework which did not provide for the issuance of fines to such clinics. The First Circuit Court of Appeal agreed, vacating the fines and holding that the Department lacked the authority to impose them.
